acom hotels terms & conditions

These General Terms and Conditions (‘GTC’) shall apply to all bookings of hotel rooms at the acom Hotel Berlin Kurfürstendamm, of acom hotel rooms in Germany, and to all other services and deliveries provided in connection therewith by Premier Inn GmbH as the operating company of acom Hotels in Germany.

When you make a booking, you agree to these T&Cs.

We reserve the right to change these T&Cs at any time. You should therefore review them each time you make a booking. Your booking is subject to the T&C in the version valid on the day of booking.

These Terms and Conditions are issued by Premier Inn GmbH, registered in the Commercial Register of the Local Court of Frankfurt am Main under HRB 99153. VAT ID No.: DE 297308020 and located atFriedrich-Ebert-Anlage 49, 60308 Frankfurt am Main (hereinafter individually or collectively “acom Hotel(s)”, “we”, “our”, “us”).

To book a room at our acom hotels, you must be at least 18 years old. For your booking we need the data of your credit or debit card. We accept Visa, MasterCard and American Express to secure a booking. Your card will only be charged to secure the booking if this is required for the chosen rate.

Children under 16 years of age may only stay at an acom hotel in Germany together with a parent or legal guardian.

Minors between the ages of 16 and 18 are allowed to stay at our acom hotels. However, we require the form for minors traveling alone, signed by an authorized person, and a copy of the ID of a parent or legal guardian at check-in.

Please check that the details in your booking confirmation are complete and correct when you receive your booking confirmation. We are not liable for any delay or non-performance of the contract if you provide us with incorrect or incomplete information.

Upon receipt of your booking, we will send you a confirmation email to the email address you provided during the booking process. Upon receipt of this confirmation email, the contract for the provision of your room, meals as well as any additional services added by you becomes valid.

The contract is concluded in the German language.

Group booking from 10 rooms:

A booking of ten rooms or more is considered a group booking. Our group booking team will be happy to assist you in booking 10 rooms or more. Send us your individual request to reservierung.berlinkudamm@acomhotels.com.

Group bookings may be subject to additional terms and conditions, and may require a backup deposit or full prepayment.

If you have booked your room through a booking portal other than the one provided by us or through a tour operator, please contact the relevant booking portal or tour operator. Other booking conditions may apply.

Individual reservation up to 9 rooms:

For reservations up to 9 rooms, our reservation team is available from Monday to Friday 8 a.m. to 7 p.m. and on Saturdays and holidays 9:30 a.m. to 6 p.m. under the telephone number 
+49 (0) 30 889 11 – 590 for you.

We use a dynamic pricing model. Prices for our rooms vary depending on demand.

When you make a booking request, we will send you a total price that includes the requested room(s) and the number of nights.

 
Room rates are per room for one night’s stay and include the applicable VAT rate at the time of booking. If the VAT rate has changed between the time of your booking and the time of your stay, we will adjust your invoice accordingly, unless you have already paid your booking in full before the changed VAT rate came into effect.

All local taxes applicable to your booking (e.g. local taxes) are shown separately and are payable in addition to the total room rate. The 
amount of the levy is based on the rate applicable 
at the time of your stay. We reserve the right to adjust the amount payable by you should the rate change between the time of your booking and the time of your stay.

Meals and other extras are not included in the room rate, but you can add them to your reservation during the booking process, if available, or book them during your stay.

Maximum two adults or teenagers over 16 years old can stay in one room. In family rooms (if available) up to two adults or teenagers over 16 years and two children (under 16 years) can stay overnight. The respective valid maximum room occupancy may not be exceeded.

Most acom hotels have rooms specially equipped for guests with disabilities. If you require such a room, please contact us before confirming your booking. We will do our best to accommodate your request if accessible rooms are available.

Although we also try to meet individual guest requests, all rooms and additional services are subject to availability. Additional services may be charged separately, and should this be the case, we will inform you in advance about the respective prices.

Meals are not included in the room price. You can add breakfast when you book or during your stay.

If you have not paid in full for your room and additional extras of your booking at the time of booking, you will have to make the payment on the spot at the hotel.

All extras purchased during your stay with us must be paid for separately at the time of purchase. In this case, the price indicated at the time of purchase applies.

We accept the following credit and debit cards: Visa, MasterCard, American Express and Maestro. The expiration date of your card must be after the end of your stay. Your card will be charged immediately after payment.

Payment at the hotel can also be made in cash. We do not accept cash checks or other forms of payment.

A withdrawal from the contract concluded with us or a cancellation of a booking made is only possible if a right of withdrawal/cancellation has been expressly agreed, another statutory right of withdrawal exists or if we expressly agree to the cancellation of the contract. The agreement of a right of withdrawal/cancellation as well as the possible consent to a cancellation of the contract must be made in text form. If there is no right of withdrawal/cancellation, the agreed price shall be payable even if the customer does not make use of contractual services.

If a date for withdrawal from the contract or cancellation has been agreed in writing, the customer may withdraw from the contract until then without triggering claims for payment or damages. The customer’s right of withdrawal expires if the right of withdrawal is not exercised in writing by the agreed date. If a right of withdrawal or cancellation has not been agreed or has already expired, there is also no statutory right of withdrawal or cancellation and the hotel does not agree to a cancellation of the contract, we retain the right to the agreed remuneration despite the non-utilization of the service.

In the case of unused rooms, the income from renting the rooms to other parties and the saved expenses will be credited.

We can lump sum the damage incurred and to be compensated. 90% of the contractually agreed price for overnight stay with or without breakfast must be paid in this case.

We are entitled to cancel your booking with written notice (including email) at any time with immediate effect if:

 
• you fail to make payments required by us in a timely manner, or
• You otherwise materially breach or have materially breached your current or a past contract with us.
 

We reserve our legal rights regarding your breach of contract if we cancel your booking due to your fault.

In the event of circumstances beyond our control (including strikes, explosions, fires, floods, power outages, water supply disruptions and emergency evacuations, regulatory requirements due to pandemics), and due to which we are unable to provide a room for you, we may cancel your booking. In this case we will notify you immediately, and

• if you have already paid for your room in full, we will refund the full price; or
• if you have not yet paid for your room, you do not have to make a payment to us.

 
Brand change or renovation:

We can also cancel your reservation if we make a brand change or renovation of the hotel in question and therefore we cannot guarantee your room. In this case we will notify you at least 1 week before the date of your reservation, and

• if you have already paid for your room in full, we will refund the full price; or
• if you have not yet paid for your room, you do not have to make a payment to us.

Except as set forth above, we shall not be liable or responsible for any failure to perform or delay in performance of our contractual obligations if caused by events beyond our control.

 
Your statutory mandatory rights remain unaffected.

Rooms are available from 15:00 on the day of arrival. Please inform the booked acom hotel if you expect to arrive after 23:00 local time.

 
Guests will be asked to provide identification and proof of citizenship at check-in. You may be asked to fill out a registration form Foreign guests are required by law to provide their ID number. The following identification documents are accepted: Passport or ID card or equivalent national valid identification documents for international guests.

Rooms must be vacated by 11:00 am local time on the day of departure. If you do not vacate your room by this time, a “late check-out” fee of EUR 25 may be charged.

You, and in the case of a group booking, the members of your group, may not resell or transfer any booking (or any part thereof). In addition, you, and in the case of a group booking, the members of your group, may not advertise, market or otherwise offer for sale any of our rooms, either independently or as part of a combined offer. We do not accept any bookings made in this manner and assume no liability for them.

 
The following is prohibited:

 
• Threaten or insult the hotel team before, during or after your stay;
• Smoking on the premises of acom hotels. This also includes the smoking of e-cigarettes. Smoking zones are designated on site. Smoking on acom Hotels premises outside of designated smoking areas will be subject to a fine of €250 – we will set this amount higher or lower if higher or lower cleaning costs have been incurred or higher or lower damage has been caused;
• Causing a hazard to the health and safety of any of our team members or our guests;
• bringing pets onto the premises of acom Hotels, with the exception of assistance dogs, which are identified as such;
• Engage in unlawful activities (e.g., taking illegal substances) during your stay at an acom hotel;
• bringing potentially hazardous substances and objects onto acom Hotels premises;
• the use of electrical appliances that may trigger the fire alarm, such as toasters, electric stove tops and grills;
• the manipulation of the fire alarm and other emergency equipment;
• removing, damaging or destroying property belonging to acom Hotels;
• using the technology provided by acom Hotels to download or access • unauthorized or obscene content; and
• the unreasonable harassment of other guests or acom Hotels staff.

If you, or in the case of a group booking, any member of your group, cause any damage or loss to the property of the hotel or other guests, you (as the booking person in the case of a group booking) shall be responsible for the damage or loss and shall be liable to pay to us on demand the amount necessary to make good such damage or loss.

 
If you, or in the case of a group booking, any member of your group, cause damage to the property of the hotel, other guests or their property, or otherwise materially violate these T&C, we reserve the right:

• Cancel your booking with immediate effect and (if necessary) remove you, and in the case of a group booking, your group from the property;
• retain any amounts paid by you or charge you the full amount for your booking (but provided that you do not prove that our damages and claim for compensation are actually less than the amount charged) and/or
• refuse future bookings from you and/or deny you access to accommodations of any acom hotels.

 
We are not obligated to make refunds or pay compensation in such cases.

Our legal liability for damages is limited as follows:

 
We shall be liable with respect to damages based on a slightly negligent breach of essential contractual obligations (“cardinal obligation”, i.e. an obligation the fulfillment of which makes the proper performance of the contract possible in the first place, the breach of which jeopardizes the achievement of the purpose of the contract and the observance of which you regularly rely on) only up to the amount of damages that are typically foreseeable at the time of the conclusion of the booking contract;
We do not assume liability for damages resulting from a slightly negligent breach of nonessential contractual obligations.

 
This limitation of liability does not apply in cases of mandatory legal liability (for example, in the case of liability under the Product Liability Act and liability for items brought in by guests in accordance with § 701 and § 702 of the German Civil Code), in the case of the assumption of a guarantee, in the case of liability for damage caused by an intentional or grossly negligent act or culpably caused bodily injury.

Photos on our website and in our brochures are for information and illustration purposes only. They are not a guarantee of any particular condition or amenities or floor plan of the rooms you book. Although every effort has been made to ensure that the impression conveyed by photographs, graphical representations and texts of the accommodation and services offered in the respective hotel is as reliable as possible, due to the large number of rooms or due to changes in the furniture, the brand of the hotel or renovations, there may be deviations between the room depicted and the room actually booked. In this respect, you are not entitled to any grounds for complaint.

Unless you are a consumer and to the extent permitted by law, we shall not be liable to you for:

 
• lost revenue;
• lost business opportunities,
• Business Interruption;
• lost profits or the conclusion of contracts;
• foregone savings;
• Data loss;
• Loss of reputation and/or loss of goodwill;
• management or office time spent in vain.

Unless you are a consumer and we are liable to you, our liability (to the extent permitted by law) whether in contract, tort (including negligence) or for breach of statutory duty shall in no event exceed the total price of your booking.
 

You are obligated to take all reasonable measures to mitigate damages.

We reserve the right to:

• Change your room assignment and/or hotel location at any time during your stay for any reason; or

• Cancel your booking(s) due to health and safety concerns or full or partial closure of the hotel. If we have to cancel your booking(s), we will try to notify you and a full refund will be initiated to the same debit / credit card. However, it may take a few days for the credit to arrive in your account.

Applicable law/jurisdiction

If you are a corporate customer, it is hereby agreed that the laws of the Federal Republic of Austria shall apply to these GTC, their subject matter and their formation (and to non-contractual claims or disputes), as well as to their interpretation, and that the courts of Frankfurt am Main shall have non-exclusive jurisdiction over any claims arising out of or in connection with your booking and/or stay at one of our hotels.

We reserve the right to assert claims for breach of these TOS in your country of residence or any other country with which you have a connection, if applicable.
 

If you are a consumer, you may have certain rights under applicable consumer protection laws. Such rights remain unaffected by these GTC.

Severability clause

If any provision of these TOS is held to be invalid, illegal or unenforceable, that provision shall be deemed deleted and shall not affect the validity and enforceability of any remaining provisions. Any failure by us to exercise any of our rights or remedies under these TOS or otherwise shall not be deemed a waiver by us of such or any other rights or remedies.
